Shwe Stream TERMS OF USE
Subscribers of Shwe Stream service need to use the service according to our Terms of Use. Your continued use of the service constitutes your agreement to the Terms, which may be updated by us from time to time without notice you. You can review the most current version of the Terms of use at any time at and Shwe Stream reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently. But Shwe Stream and/ or Payment Gate Ways will not have any responsibility for that. Shwe Stream service and/ or MPT and their members will not have any responsibility for any loss or damage of your welfare (including your personal data and cash) directly or indirectly (OR) unable to get Shwe Stream service due to your carelessness while getting Shwe Stream service by registration. Detail Terms of Use are as follow.
1. Registration to be a member.
We may require you to register or otherwise provide information about yourself in order to use Shwe Stream service or certain of its functionalities. You agree to provide current, true, accurate and complete information about yourself as prompted by the Service. You consent and agree that Shwe Stream may access, preserve and disclose your user data provided during registration if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to provide the Service to you and to respond to your request for customer service, comply with legal process, enforce the Terms, respond to claims that any description violates the rights of third parties and to send the information about the Service to you. By registration for Shwe Stream service, you accept and agree to be sent all information in the form of SMS and SMS link concerned with this Service.
2. Service Fee
It will be charged in full to your phone bill or Mobile Wallet/ Visa, Master Bank Account and Apple ID Payment, for the service fees of watching the film, videos, and series according to the payment system selected by you.
These service fees are only for watching Myanmar Films, Myanmar Movies and Korea Series, Indian Movies for streaming or downloading Films, Movies and Series will be cost further data charges.
3. Billing
You agree and accept us to charge you service fees and pay per view fee for watching Films, Videos and Series from registered phone bill. And you also agree to pay for necessary taxes. As for subscription plan, Service fee will start billing to your phone bill and it will be auto-renewed according to subscription plan if you have subscribed to the service. We reserve the right to adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. Any price changes to your service will take effect SMS notice to you by Shwe Stream. Payments are nonrefundable and Shwe Stream does not commit to provide refunds or credits for any reason. If you subscribe, your Shwe Stream subscription will continue in effect on a day to day/ week to week/ Month to month basis according to subscription plan unless and until you cancel your subscription, or we terminate it.
If anyone else not you or any organization that you know or not is using your phone (OR) using your Sim Card (OR) using Sim Card registered with your personal information have subscribed Shwe Stream service, we will bill subscription fee and pay per view fee to your phone bill.
4. Service
You have to pay service fees fully to use Shwe Stream Service and can watch Myanmar Movies and Korea Series. Depend on your selection you can watch relevant Films, Movies and Series. You agree to use this service to stream or download films, videos or series to for your personal enjoyment/ use only. You are allowed to download, temporarily store and access one or more content titles on one approved, registered device for personal, non-commercial purposes for up to seven days. You acknowledge that if during such downloaded period you stop using Shwe Stream, the distributor from whom Shwe Stream licenses the content requires Shwe Stream to withdraw the content (meaning we cannot stream it anymore), you may not be able to continue to access some of the content downloaded as it may self-destruct, and, to the full extent permitted by law, in that event Shwe Stream will not have any liability to you.
You agree not to archive, download (other than through caching necessary for personal use), reproduce, distribute, modify, display, perform, publish, broadcast, deliver, produce, copy, modify, transmit, perform, publish, store in not allowable devices, share by not allowable ways and create derivative works from, offer for sale. You also agree that we can make advanced test and watch Films, Videos, Series, Content and other information. Shwe Stream reserves the right to make advanced testing, watching, cancelling, and terminating subscription concerned with the content in Shwe Stream with its sole decision.
5. Unsubscription/ Cancellation
If you would like to unsubscribe our service, you can unsubscribe by the unsubscription way of the respective operators. You agree that Shwe Stream may in its sole discretion, suspend or terminate your account and/ or access to the Service and/ or billing for no reason, without notice. You acknowledge and agree that under no circumstances will Shwe Stream be liable to you or any third party in any suspension, termination, cancellation or unsubscription.
6. Devices
You can use our service via smartphones, tablets, computers, laptops and smart TVs which can connect internet. You only take responsibility for installing or browsing and/ or using our service via your devices. Even you cannot use our service even you have already subscribed our service due to underperformance of your devices or if your devices are not compatible with our lowest specifications, you have need to pay for you the service fee. Thus, you may need to check whether your devices are support to use Shwe Stream or not. Shwe stream will not take responsibility for you cannot use our service under the circumstances of you are using underperformance devices or incompatible devices. The quality of the display of the streaming content may vary from device to device (depending on where you are streaming Shwe Stream from), and may be affected by a bunch of factors, such as your location, the bandwdich available and/ or speed of your internet connection. To use Shwe Stream service, you have need to subscribe our service as per our statement of lowest devices and software specification occasionally. We will not take responsibility for the problems or issues due to devices and software that are not compatible with our lowest specification.
7. Sending Notifications
By using Shwe Stream service, you agree to receive notifications send from our service and/ or to get a contact to your registered phone number from Shwe Stream service. We may notify you about new films, new plans, promotion plans or collect user survey data via Shwe Stream App, SMS or other ways of communication. Moreover, you agree to receive notifications of payment bill for watching videos, agreements, statements, announcements and other information sent by Shwe Stream. We may provide the means for you to submit information, data, text, software, sound, photographs, graphics, videos, messages, tags or other materials to Shwe Stream service. You are solely responsible for any description that you submit while registration process and the consequences of submitting it.
8. Restrictions
You don’t have right to use Shwe Stream service for commercial purposes. Shwe Stream service is for your personal and noncommercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, reverse engineer, transfer or sell for any commercial purposes any portion of the service use of the service or access to the service. You agree not to archive, download (other than through caching necessary for personal use), reproduce, distribute, display, publish, broadcast, deliver, produce, copy, modify, transmit, perform, publish, store in not allowable device, share by not allowable way and create derivative works from, offer for sale. If you breach our restrictions, you will be taken action legally by current Myanmar laws and you have to take responsibility for all consequences and loss of Shwe Stream service. You agree to use Shwe Stream service and watch Films, Videos and Series as per these Terms of Use legally.
You agree not to access the service (1) by any means other than through the interface that is provided by Shwe Stream for use in accessing the service, (2) through any automated means (including the use of any Robot, Spider, Scraper, Script or Web Crawler) or (3) by forging or manipulating identifiers in order to disguise the origin of any access to the service, (4) by using any software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any Shwe Stream service, (5) by uploading, posting, writing e-mail or using any software viruses by the intention of interfere with Shwe Stream service.
You should not make to increase the view rate of the content owners provide for Shwe Stream service unfairly with the intention of raising income for the content owners. If we inquire and find such case, we will cancel those unfair view rates or view counts.
You have to use Shwe Stream service within our Terms of Use and restrictions. You agree to use Shwe Stream service without breaching or breaking our Terms of Use, restrictions, rules and regulations and beyond our limitations. And you are not allowed to use Shwe Stream Service’s social media pages such as Facebook page, Instagram, YouTube and Web Page without permission of Shwe Stream service.
9. Intellectually Property Rights
The term Shwe Stream and all the trademarks used in Shwe Stream service (including the name of Shwe Stream and other trademarks), logos, business names and service names are the exclusive trademarks of and are owned by Shwe Stream, Shwe Stream’s business partners and other related companies. Any third-party trademarks or service marks displayed on the service are the property of their respective owners. The chance we give to you for using our service does not include the right or usage of those trademarks, logos, business names and service names. You will have the right to use those chances only when you have the legal authorization letter of Shwe Stream service, its suppliers, and its business partners. You don’t have the right to use it for referring Shwe Stream service or anything else.
10. Liability Disclaimer
In no event shall Shwe Stream, MPT, their members, staffs, representatives, business partners, owners of copyright or patent be liable to you or any third party for breaking the Terms of Use, any direct, indirect, punitive, incidental, special or consequential damages arising out of or in any way connected with your use of, or inability to use, the service or any information, software, products, services, third party dealings, or description obtained or accessed through the service, whether based on contract, tort, strict liability or otherwise. You acknowledge and agree to take sole responsibility and take action for all cases.
11. Declaration
The above Terms of Use are legal. We regard that you acknowledge and agree to all these Terms of Use by using, visiting, or browsing the Shwe Stream service. It will be your sole responsibility for using Shwe Stream service without reading our Terms of Use.
12. Governing Law & Jurisdiction
All of above Terms of Use shall be governed by and construed in accordance with the laws of Myanmar, and you agree to consent to jurisdiction of the competent Myanmar Courts.
